, the supreme court has notify the us it will take us gay marriage cases including california's ban on same-sex marriage unions. we got the word and our correspondent is with us on the phone now. shannon, what is the story? >>shannon: they decided to take up to different gay marriage cases. you mention the one from california, you may remember proposition eight. the voters passed a measure that allows only the recognition of one man, one woman as a "marriage." a federal court overturned that. that want on appeal to the supreme court and they decided they will weigh in on that fight. in addition there were eight cases on the diagnosis -- the docket on the defense of marriage act and a portion only recognizes marriage as between a man and a woman and has been challenged dozens of times. they agreed to take up a case dealing with defense of marriage act. two different cases but both going to the same issues. they are different on technical and legal points but the bottom line is the same and the court has told us it will hear two gay marriage cases and we expect the earliest to get on the cale

. they would hear the prop 8 case out of california. prop 8 is the california ballot proposition which amended the california constitution to define marriage between a man and a woman. the court will some time this year, probably in june, decide whether that amendment is unconstitutional. but the court also said it would hear a challenge to the defense of marriage act, a 1996 law passed under president clinton that defined marriage between a man and a woman for the purposes of federal law. the question is why now? why did the supreme court choose this moment? nine states and washington, d.c. all recognize same-sex marriage now. that doesn't seem like very many but it's happening quickly. three of those states people voted to legal marriage in november. maryland, maine, washington. first time ever done so. there's a big public opinion trend here. since '04, "the washington post" abc news polls have been asking people should it be legal or illegal for gay and lesbian couples to get married? in 2004, 59% of people said they thought it should be against the law. in 2012 it was almost the opposite.

in california, that case, whether the ban on same sex marriage there is unconstitutional. and that could affect all 50 states. so there is at least the potential that by the end of june, all 50 states will be ordered to have same sex marriage. there is a long way between here and there, but that is now a possibility. >> what is so interesting about this, this is not just about the marriage issue, so much as it is an equal protection issue because so many people have been denied benefits under federal law. >> that's the defense of marriage act case. what the defense of marriage act case, what the law says, passed in 1996, signed into law by president clinton, that law says that the federal government will not recognize same sex marriages, even in the states where it's legal. so if you are a married couple, same sex couple in massachusetts, you can't file a joint tax return, can't inherit tax free the way heterosexual married couples can. the obama administration says, agrees that law is unconstitutional. that law is now being defended by a lawyer hired by the republicans in the house of represen

of marriage act that defines marriage as only the union between a man and woman and california's proposition 8 which banned gay marriage was overturned by an appeals court. cnn's crime and justice correspondent joe johns has been following both cases for us. joe, explain the impact of today's decision. >> well, it is big impact. as you know, this is one of those cases that people talk about over the water cooler. let's start with proposition 8. very simple, wolf, it is the california ballot initiative passed in 2008 by the people of the state of california that established marriage as between a man and a woman. it overturned a court case that said same sex couples have the right to marry. windsor is the other case you were talking about, it is an attack on defense of marriage act which was passed in 1996 by the congress, signed by the president. it's called windsor against the united states. it is about a woman named edith windsor who had a long time relationship with her partner, and they were married in 2007. spier died in new york in 2009, and edith windsor got a lot of money. something lik
